Well, this is a new one… Here we have a company accused of copying some other company’s product design and what do they do? They go out and claim that the design wasn’t original in the first place. How about that? I’m talking about Samsung and Apple, with the product in question being the iPad.

Samsung has just filed a suit to invalidate Apple’s design rights for the iPad, at least in Europe. The reason for this? Samsung is claiming that this design has been around for a while now and long before the iPad. The application for this purpose was filed to the Office for Harmonization in the Internal Market on August 9, according to Korea Times.

If everything goes well this time, Samsung could improve its position in the case that Apple has against it in Europe against the Galaxy Tab 10.1. This Samsung attack comes fresh after the injunction against the iPhone 4S in France and Italy. It’s an all out Samsung offensive here and we can’t tell what the future holds. I’m guessing that Apple will retaliate soon…
