You might be aware of the fact that Samsung has had its Galaxy Tab 10.1 tablet banned from Australia and Germany, after a series of lawsuits, that ended with verdicts favouring Apple. Now, an appeals judge from Australia is saying that the ruling banning the tablet from kangaroo country is unfair.

Samsung lawyer, Neil Young (the singer?!) says that the lawyer from the original case didn’t take into account the consequences that the ban will have on Samsung during the shopping season. “Fundamental errors of disposition of the interlocutory application” were quoted, as well as “errors of principle”. Samsung wants the injunction lifted early next week, if possible…

Samsung has already counter sued Apple in Australia, also seeking a ban on the iProducts, but this suit will develop in March. The battles between the giants are taking place all over the world, including in Germany, the Netherlands, France, Japan and the USA. Considering that even a judge claims that the Samsung ban is wrong, what more do you want as proof that Apple is overdoing it?
